The Michael Ovitz-backed Scour, which produces a simply wicked P2P (person-to-person--add it to your TLA list) app and a Web-based search engine, is now being sued by both the music industry and the film industry, a feat even Napster didn't pull off. I've had the Scour Exchange application on my computer for a month now. It's brilliant. The software is essentially Version 3.0 of Napster, which means it has a real user interface (as opposed Napster's clunky front end), it is much more stable, and it allows users to search for content in any media format (i.e., both video and audio). I've been using the software to download and watch movies including Gladiator, TITAN AE, South Park and Scary Movie. Now, I'm a movie fanatic, as many of you know. I spend more money than I probably should on DVDs, I obsess over Sony A/V products, and I pick where I see movies based on the sound system and size of the theater. This, of course, makes me a fairly unobjective candidate for rating movie watching. However, I can say one thing definitively: You will watch movies on your PCs. I know--for more than five years you've been hearing pundits argue that no one will ever want to sit in front of a computer to watch movies. Of course, the people saying that are people from traditional media business. I'd like to share a couple of conclusions I've formed: -You will watch full-length movies on your PC, but only certain types of movies and in certain settings. -The Internet will cause a rash of piracy in the movie business that will make street-corner bootleg sales truly insignificant. -Within five years, movies will be released in theaters and on the Internet at the same time. People will go to theaters because they want to, not because they have to. -The movie industry will have nothing to worry about if it gives consumers what they want. As a matter of fact, I think the industry will make more money with this new plan. Point 1: You will watch movies on your PC. The meme that people don't want to watch movies on PCs is simply wrong. Case in point: If Star Wars Episode I: The Phantom Menace had been available online before or during its first week in theaters, millions of people would have sat in front of their PCs and watched the movie. I'm finding that certain movie genres are better-suited to desk viewing, namely animated films and comedies. I downloaded Scary Movie, TITAN AE, and South Park (the first are in theaters right now; the latter is already out on video/DVD). They're great to watch on a PC because they don't require the perfection of DVD-quality video. (Jokes are just as funny on a 17-inch monitor as they are on a 32-inch TV or in a movie theater). Also, pausing a comedy such as Scary Movie doesn't really detract from the experience--certainly not as much as pausing Manchurian Candidate or Three Days of the Condor. Certain movies clearly do not work on PCs right now--unless you're viewing a DVD, or rewatching something you're already seen. Take Gladiator: I've seen it both in theaters and on my PC, and it's obvious that Ridley Scott's genius is meant for the big screen. (Of course, I'm an extreme case--I like to advocate the perpetual release of the Blade Runner director's cut in theaters around the world.) If you're a business traveler, you already know that having a DVD player on your laptop is key to defeating the boredom of watching the same bad film four times in a month. I recently watched Taxi Driver on the way to L.A.--a much better option than a third round of Entrapment. (Of course, on-plane viewing has some dangerous side effects. Just as the credits popped up after Taxi Driver, I stretched out and noticed a wide-eyed 10-year-old kid watching the film over my shoulder. Adding to my guilt: Scorsese is a big fan of colorful language, and I had the subtitles on). Point Two: The movie industry is going to have some major piracy issues. In the old days, it took a lot of time, money, and equipment (dozens of VCRs, blank tapes, etc.) to distribute a pirated movie. Movie quality degraded after each generation of copies, and it took time to send them around the world. If you've ever bought a film off a street corner in Chinatown, you know what I'm talking about. During my adventures in Scour-land I've been able to find high-quality screening versions of many first-run movies. These films are being transferred around the world in non-degrading quality at record speed. Additionally, as video cameras get cheaper, better, and smaller, the quality of movies captured through open-air video taping (a.k.a, sneaking a handheld Sony into the theater) is getting better and better. Sure, the quality isn't as good as it would be in a theater, but for a movie like South Park or Me, Myself and Irene, who cares? The film is still just as funny. With most DVD players supporting the video CD format, transferring a film online and popping in your DVD player is becoming a reality. However, the process still takes a lot of arcane software and time--so, just as downloading and trading audio files was difficult four years ago, burning video CDs remains a year or two away from reaching a Napster-like level of acceptance. As a side note, when I announced to the office recently that I had Scary Movie on my PC, I instantly had three people around my desk watching the film for 10 minutes. We would have pulled up chairs and watched the whole thing if we hadn't been on deadline (and were I not signing the paychecks). Points Three & Point Four: You can't fight a wave, but you can surf it. Since the movie industry will not be able to stop this piracy (see my arguments about not being able to stop Napster), they will be left without any option but to release movies on a pay-per-view basis (on the Internet or otherwise) and in theaters at the same time. Again, in the future, people will go to the movies because they want to, not because they have to. This is going to be a hard pill for the movie industry to swallow, considering it has spent nearly a century building a finely tuned revenue system of "windows," with which movies have more lives then a cat. (Add 'em up: multiple theatrical releases, then international, pay-per-view, video, DVD, airplane licensing, premium cable, standard cable, network TV, and on and on.) So, what's my point in all of this? That the movie industry should look at the Internet as an opportunity and not as a threat. Its leaders have the next 24 months to figure this one out, and if they play their cards right, they'll be able to make even more money than they are now. Imagine a world in which costly individual-distribution units no longer exist--a world where movies are beamed via satellite to theaters around the world. A world in which megaplexes can switch their movie lineups on the fly: "Hey, this Full Monty thing seems to be a hit. Let's put it in 300 more theaters nationwide--now." Of course, the movie industry could sit back and wait and, like the music industry, watch its role in the process be limited to litigation instead of innovation. From what I see on the Digital Coast (a.ka. Hollywood), I give the movie industry a 50/50 chance of getting it right--which is far better odds than I'd ever give the music industry. San Francisco-based Gay.com and New York-based Gay Financial Network have formed a strategic alliance allowing shared content between the two sites. In addition, Gay.com acquired an undisclosed equity position in GFN. "We view Gay.com as the No. 1 portal, and are excited to test this concept with them," said Walter Schubert, CEO of GFN, adding that the company maintains a friendly relationship with PlanetOut (which is partnered with a number of high-profile online and offline properties, including America Online and Liberation Publications). "Right now, our focus is to make this work for GFN and Gay.com members," he said. Gay.com's significant financial backing (the company has raised more than $20 million from heavyweights such as Flatiron Partners and Chase Capital) and broad community appeal make it a likely candidate to acquire the smaller GFN. GFN fills a niche market, providing relevant information for the gay community's unique financial needs. While neither company would comment outright on the possibility of an acquisition, both offered hints of a growing long-term relationship. "I would say that Gay.com is aggressively building out its financial-services offerings," Gay.com CEO Walter Schubert said. "Long-term, the idea is that we'll continue to build, and hopefully deepen, our relationship with GFN." The two companies had been toying with the idea of an alliance for about a year; Schubert said the talks of a partnership became more serious over the last six months. Under the terms of the agreement, in addition to the equity stake, Gay.com will receive financial-information content from GFN. GFN will receive traffic and advertising from Gay.com. New York Senate hopeful Hillary Rodham Clinton will be special guest at "An Evening With New York's High Technology Community" on September 8 to benefit the Democratic Party's New York Senate 2000 fundraising committee. What's most interesting, of course, is that she will joined by her husband, President of the United States William Jefferson Clinton (otherwise known as the most powerful man in the world), who gets second billing. Five U.S. Senators, including New York's Chuck Schumer, will be there as well. More importantly, the presidential involvement is a clear sign that Silicon Alley has arrived on the national political parties' radar screen. "That's a major fundraiser," said Bruce Bernstein, president of the New York Software Industry Association, which has been working to get more Silicon Alley firms involved in the political process for quite a while. "That's an indication that Silicon Alley is being taken much more seriously," he added. Josh Isay, director of public policy for DoubleClick and Sen. Schumer's former chief of staff, said the event's inclusion of both the president and Hillary Clinton, as well as five senators, is a clear indication that "elected officials in Washington are beginning to understand that New York's high tech sector is growing rapidly, and is now one of the centers of the new economy, along with Silicon Valley. ...New York's high tech community is definitely on the A-list." Aside from the presidential campaign and Hillary Clinton's high-profile Senate race, Silicon Alley firms have turned their attention more and more toward government over a number of issues, ranging from privacy online to visas for foreign workers. New York Senate 2000 is a joint fundraising committee authorized by the Hillary Rodham Clinton for U.S. Senate Committee, the Democratic Senatorial Campaign Committee, and the New York State Democratic Committee. A spokesperson did not return calls seeking comment by press time. Nor was the price of tickets available, although it's likely to be high--in the $500 to $1,000 range, at the very least. Along with the Clintons and Schumer, the event will be attended by New Jersey Sen. Robert Torricelli, Vermont Sen. Patrick Leahy, West Virginia Sen. Jay Rockefeller, and Oregon Sen. Ron Wyden. The companies jointly announced that Verio agreed not to use Register.com's whois database to cull e-mail addresses, addresses, and telephone numbers of Register.com customers for marketing use while the matter remains under dispute. Verio also agreed not to use any customer information it had previously obtained from Register.com's whois database. Contributions to the whois database, which contains contact information for all registered websites, is required of all domain registrars accredited by the Internet Corporation for Assigned Names and Numbers (ICANN). As part of yesterday's agreement, both companies agreed not to comment on the case until it is settled. Register.com filed a complaint against Verio August 3, accusing Verio of using the whois database in violation of its terms of use, and of misleading customers into thinking Verio was contacting them on behalf of Register.com. Verio denies it has done anything wrong. A Verio spokesperson told the Daily in an earlier story that the company followed all ICANN rules and regulations. "The broader picture is the information as registered is public information," said Mona Peloquin, a Verio spokeswoman. "It's a standard marketing practice." Sascha Mornell, Register.com's senior VP for sales and marketing, disagreed, telling the Daily earlier that Register.com had received hundreds of customer complaints about Verio's actions. "For every customer that complains, there's 50 to 100 who feel the same sentiments," he said. A hearing on Register.com's application for a preliminary injunction against Verio is scheduled for September 15. Earlier this year, the publicly traded company snapped up its main rival, Boston-based Dragon Systems, for $460 million in stock. Just yesterday, though, The Wall Street Journal published an investigative piece that questions L&H's list of supposed clients in Korea. Officials at L&H criticized the article, but saw its stock drop 19 percent. The company has experienced this type of scrutiny more than once. Last year, the SEC forced the company to restate its earnings for all of 1997 and the first nine months of 1998 because of questionable accounting practices. Even with its problems, L&H has proved to be an innovative and visionary company that may one day realize its dream of people talking to computers. Danny Lein, co-founder of the Belgian incubator VentureBay.com and a founder of First Tuesday-Brussels, studied L&H while attending the French business school, INSEAD. Lein respects the company's achievements and vision, and calls L&H a role model for other Belgian companies. "[They] showed people they could create jobs in a region in Belgium that has historically been a farming region," Lein says. "They established a learning center and attracted international companies." While I did not meet either Jo Lernout or Pol Hauspie, I did spend some time with Stijn Bijnens, the CEO of Ubizen and the Belgian technology leader mentioned most during my visit. With a market cap of about $1.5 billion, Ubizen can rightfully claim the title "global leader" in providing security solutions for e-business. Its client list includes J.P Morgan, Toyota, British Telecom, and Belgium's National Bank, among many others. Ubizen was spun off from Leuven University (the largest university in Belgium) in May 1995. Bijnens, a researcher in the computer science department, became its leader and has since grown the company to more than 500 employees worldwide. Among its offerings are infrastructure security (i.e., firewalls), round-the-clock systems monitoring, knowledge management, and transaction and authorization solutions. Acquiring an e-business security company in Northern Virginia a year ago gave Ubizen a much-needed foothold in the U.S. market. Bijnens says he is "not against" another acquisition in the United States. "It's more difficult for a European company to sell into the U.S.," he explains. "We were able to win J.P. Morgan [as a client], and that proves we have a specific technology and that there is a market for us." Like me, you may wonder why you've never heard of Ubizen, which is listed on the Easdaq and is planning a Nasdaq listing. While Bijnens believes the American business press has ignored the company because it's based in Belgium, he also admits, "We need to build up a marketing machine in the U.S." Walter De Brouwer, a serial entrepreneur and founder and CEO of Brussels-based Starlab, has already mastered a suave style of marketing. His "blue-sky" research lab employs 63 world-class scientists and 25 businesspeople in the hope of turning findings into profitable spin-offs. He has already received considerable press attention for his four-year-old company, including a prominent place in Fast Company's recent Roadshow 2000. Walking into the serene and tastefully decorated hall of the company's chic brownstone-style residence, and then meeting the eccentric De Brouwer in his spacious office (filled with books and hefty brown leather sofa and chairs) made me feel as if I'd walked into Roald Dahl's famous book, Charlie and the Chocolate Factory, with De Brouwer as Willy Wonka. When I compared my interview notes to the FC piece, I found that De Brouwer gave me nearly the same pitch and answers. I shouldn't be surprised--he knows how to get his message across. Starlab's main areas of research: bits (includes wearable computers), atoms (nanotechnology), neurons (artificial intelligence), and genes (genomics). Commercial partners including Adidas, Andersen Consulting, and France Telecom pay big money to be five-year partners and finance the research. All 20 members gather about twice a year to exchange ideas. A focus on the long term, rather than the dot-com's standard short term, is Starlab's lofty mission. As De Brouwer says, "When some things are out of fashion, we don't feel it." De Brouwer can't ignore the market completely when it comes to revenue-generating spin-offs. Among the current crop are Freemedschool.com (self-explanatory) and Spitters.com, a world "DNA bank" that will analyze volunteers' spit samples to create a powerful database for genetic, medical, and pharmaceutical research. The i-wear division also seems to be making commercially viable headway, announcing in June that it has developed clothing that can "identify and memorize the different objects you carry with you." Back in the more mundane, though necessary, world of getting the masses online, Belgacom's market-dominating ISP, Skynet, recently made its first acquisition outside of Belgium. At home and now in France, the company has 1 million residential and business customers. For Skynet Managing Director Philippe Lemmens, who previously ran Apple's operations in Belgium, moving into the French market makes sense. "Culturally, France is not so different from Belgium," he explains. Yet, advertising and e-commerce revenue--and growth in subscribers--have come slower than he would like. Already, Lemmens has carefully navigated Skynet through the super-hyped free-ISP wave of late '99. Skynet offers a free service, but has retained 140,000 paying customers. That's why Skynet's marketing campaign does not focus on price. "It's time to bring again a qualitative message," Lemmens says. "We don't walk to talk free price to our customers, but rather, what they can expect from the Internet." Skynet is the only ISP that was ready to offer the government-mandated lower access price (30 Belgian francs per hour off-peak, about U.S. $0.66), which went into effect June 15. Skynet's competitors are fighting the new tariff because the level of commission is too low. In the meantime, says Lemmens, "customers can benefit." With demand for high-speed access increasing, Skynet began deploying DSL lines a year ago and now covers 98 percent of the country. Lemmens realizes people will want entertainment offerings with their faster access, and sounded intrigued when I told him about Seattle-based Atomfilms.com--enough to write it down. Speaking of high-speed content, a little start-up in Gent, north of Brussels, has joined the streaming technology game to capitalize on the soon-to-explode rich-media market. StreamCase, which Belgacom Media Ventures invested in earlier this summer, has already signed on Belgium's Channel Z as a client, as well as Ernst & Young. Founders Luc Peeters and Luc De Clerck, along with a third partner, are the Belgian version of Silicon Alley's pioneers, having sold off their five-year-old interactive agency to Alcatel earlier this year. As with their website-building business, they find they have to educate their clients first. "[Channel Z] had 1,000 visitors to the website without spending money on marketing. Once they see that it works, it kind of opens their eyes," Peeters says. With only nine employees, five-month-old StreamCase already has plans to open offices in London and Amsterdam. In this nascent sector of the industry, De Clerck believes their main competitors are start-ups similar to StreamCase. "It's difficult to say who will be our biggest competitor, who will come over the ocean," he says. "We're not afraid of them. We'll see what happens."
