After drawing the ire of freelance writers by hawking their stories without their permission and without giving them royalties, Steve Brill's Contentville has reached an agreement with the National Writers Union (NWU) to develop a system that gives writers a cut from sales of their articles--but some writers are still questioning the deal, and the union's enthusiasm for it. Under terms of the deal, which was approved unanimously yesterday by the NWU's executive board, writers registered with the NWU's Publication Rights Clearinghouse (PRC) will receive 30 percent of any sales of their copyrighted articles on the Contentville site. Writers also have the option of requesting that Contentville remove their articles from the site. "It was a tough negotiation, but what made it possible was that Brill was very forthcoming and willing to work this out," said Jonathan Tasini, NWU's president. "This is a breakthrough agreement and it says to the industry that this can be done." The deal will be retroactive to Contentville's launch last month. Contentville was founded by Brill as a one-stop shop for all manner of content, from books and screenplays to doctoral dissertations and magazine articles. The company uses aggregators--Bell & Howell for theses, EBSCO for magazine articles--to provide much of its content. The Online Writers List message board lit up last month with freelancers' fury after freelance writer Cathy Dold wrote that she found copies of her articles for sale on Contentville's site. Other writers subsequently visited the site and found reprints of freelance article for which they sold only the first-run rights. After fielding calls from disgruntled writers, Tasini fired off a letter to Brill, calling on him to compensate writers for sales of their copyrighted work. After initially blaming EBSCO and Bell & Howell, Contentville moved to quell the uproar. Brill replied to Tasini's letter with a conciliatory note of his own, promising to reach an amicable agreement with the union. And after three weeks of discussion, Tasini and Brill agreed on the principles of a deal. "It's the right thing to do," Brill said of the agreement. "I think it's a real step forward for our business." Dold offered qualified support for the deal, saying the 30 percent was less than her usual 50 percent reprint royalty but better than nothing. "It's been nice to see Brill talking to people and realizing it's an issue," she said. "They can sell [my articles] as long as they give me a cut." Other writers are less sanguine about the deal. Neil DeMause fired off an e-mail to the union, later posted to MediaNews.org, questioning NWU's motives in striking the deal. "I am more and more convinced that for the NWU to be running the PRC is a gross conflict of interest," he wrote. "The PRC is potentially a good idea, but I want my union looking out for my rights when it's negotiating deals, not looking out for its pet projects. I am seriously reconsidering my support for the current union leadership, as well as my membership in the union as a whole." Freelancer Dave Wallis agreed, charging Tasini with cutting a "sweetheart deal" with Contentville. "Brill cares deeply about his image, and he desperately needed a PR boost at a time when he looked like a used-car salesman," he wrote. Some disquiet over the PRC, and the union's promotion of it, stems from confusion about how the service operates. The PRC site implies that once a writer enrolls with the PRC, the service handles all future licensing transactions (on a non-exclusive basis--writers are free to resell their work outside the PRC). "Writers give the PRC permission to act as their agent in licensing secondary rights to their previously published articles," the site states. "When the PRC signs an agreement with a secondary user, it collects the copyright fees from that publisher and distributes the royalties to its enrollees." But NWU organizer Dian Killian says it's the individual writers, not the PRC, who ultimately accept or decline resales--and that writers can reject any offer from any potential licensee. The goal of the service is to serve as a negotiating agent, not to authorize sales. Writers still have to sign contracts with each individual licensee. DeMause said he was slightly mollified by the union's expanded explanation of the PRC, but still has concerns about its influence on the NWU. "It's definitely a potential conflict of interest. I wish the union seemed a bit more aware of that," he said. "I don't think this [Contentville] deal in and of itself is a horrible betrayal of writers' rights, but it's a disturbing beginning to where this is all heading." The deal will make Contentville the first major outlet to use the PRC for compensating writers. Tasini said the final contract language remains to be worked out; he expects the Contentville/PRC exchange won't be up and running for several weeks. After 10 livery drivers were murdered during a robbery spree earlier this year, the city Taxi and Limousine Commission ordered in April that all car services and partitionless yellow cabs install either bulletproof partitions or an approved digital camera, said Allan Fromberg, a TLC spokesman. The city had been testing two digital cameras designed for taxis since last August, and approved two models in February, Fromberg said. But they were optional until the April 18 emergency meeting, following the murder of Cesar Lopez in Brooklyn. Since then, 1,077 of the cameras have been installed under the auspices of a city-funded program that subsidizes up to $325 of the cost of a partition or camera system. The cameras, made by Raywood Communications of Australia and VerifEye of Toronto, consist of an infrared digital camera with an infrared light to be mounted prominently above the rearview mirror--as a deterrent as much as anything else--and a hidden "black box" storage unit that can hold 128 to 320 black-and-white images taken in near-total darkness. The camera's storage system is on a loop, allowing continuous overwrite after about 100 pictures, which are taken automatically when passengers enter, during the ride, and when they get out, Fromberg said. The driver can unobtrusively trigger the camera to take a rapid series of images which cannot be overwritten. The images are protected even if the unit is unpowered for two weeks or more, and can be downloaded into a standard PC or transmitted to a central location via wireless modem. Last May, the Houston Chronicle published dramatic photographs of a pair of men robbing a cab driver at gunpoint, captured by Raywood's Snapshot camera system. Still, Fromberg said he did not expect the cameras to take over from partitions right away. For one thing, only 500 of the city's 12,187 yellow cabs are allowed to eschew partitions. Livery-car owners may be attracted by the fact that the city's subsidy covers the full cost of a partition, but less than half the price of a camera system. Beyond that, the partitions work. In 1993, seven yellow-cab and 35 livery-car drivers were murdered. Partitions were mandated for cabs the next year. Since then, there have been three robbery-related murders of cab drivers. That's enough for the TLC, which has stood firm in the face of complaints from emergency-room doctors that fender benders leave passengers behind partitions with broken facial bones on a regular basis. "We believe the partitions are very effective," Fromberg said, adding that the cameras are also an effective deterrent. "We do not see the cameras taking over soon." Much further down the list, and perhaps off their radar altogether, is Belgium, a small country the size of Maryland best known for being the home of the European Union--and, yes, of delicious chocolate. It's easy to focus on the country's size (about 11 million people) and fragmented culture (Flemish-speaking north, French-speaking south) as reasons not to set up business there. And yet, the majority of West European capitals are within 1,000 kilometers (about 600 miles) of Brussels. The highly educated population speaks two languages, if not three or four, on average--most commonly English and German in addition to Dutch and French. This skill, along with the ability to constantly deal with multiple cultures, is the strength most-often cited by the Belgian Internet executives I met this week. As my host and local expert, Ulrich Seldeslachts of Belgacom Media Ventures, told me, "They [Belgian entrepreneurs] are underdogs from day one. They can start developing for France and the Netherlands because they speak both or three languages fluently. It's an advantage for Belgian entrepreneurs. They're used to being confronted with different cultures." Seldeslachts should know. During the time I spent with him, he spoke four languages, depending on whom he was talking with, and changed linguistic gears effortlessly. So, unlike French or German entrepreneurs, Belgian ones can't rely on their own country's online population of approximately 3 million people. "From day one, they have to be international," says Charles De Stoop of NetFundEurope, a 71.5 million euro (U.S. $64.7 million) Belgian VC fund. "Belgium is too small to make an impressive business." NetFundEurope, a subsidiary of the specialty retailing group Mitiska, has taken the international approach itself. Of the 16 investments in its current portfolio, half are Belgian companies and the rest are based in France, the Netherlands, and the U.K.; the investments include business-to-business and business-to-consumer, service companies, and funds such as Vivendi's Viventures. Belgacom Media Ventures, a $12.5 million fund that operates fairly independently of its telecom parent, has invested in NetFundEurope. It also makes investments in non-Belgian companies. The people committed to building Internet businesses in Belgium have not been the trendsetters in Europe thus far, as they themselves admit. You can bet on Sweden and Finland for innovation, particularly in the wireless space, but Belgium's specialty is taking existing concepts and making them successes in their own right--which often makes Belgian companies attractive targets for acquisition. One such example is three-year old Proxis.com, Belgium's best-known online retailer of books and CDs. It's become the market leader at home and in the Netherlands; the company was Mitiska's first investment, and laid the groundwork for NetFundEurope. Proof that CEO Kurt Staelens understands the market's complexity: Users can select their preferred language, currency and shipping country at the top of the home page. As an American living in Amsterdam, this is exactly the type of flexibility and ease-of-use that I crave. Proxis.com combines its office and warehouse space in a somewhat bleak-looking industrial area of Vilvoorde, a town just outside Brussels. There's no dot-com flashiness here--the company name is written in white chalk on the dark-gray door, in small, elegant capital letters. Like his world-famous counterpart (the one with the nine-figure annual losses), Staelens wants Proxis.com to be a shopping portal that sells more than just books and CDs. Launching soon is the DVD and video store. Next up is magazines, newspapers and mobile phone packages. Still privately held, Proxis.com is wrapping up an undisclosed amount of financing this month. Staelens then plans to prepare a prospectus for an IPO in the first quarter next year. He's leaving his options open--options that include an acquisition (yes, he's talked with Amazon, but he believes they're not focused on the Benelux market yet) or a partnership with other locally dominant online retailers. Staelens calls the potential partnership a "European conglomeration of market leaders." Besides Proxis.com, Staelens has frequently spoken with Buecher.de, Streets OnLine (U.K.), and Alapage.com (France). He quickly adds that "it's still to early to say we're considering it seriously. "We all see the longer term," Staelens explains. "There's Bertelsmann and Amazon. Now the question is, who else is going to become a [Pan-European] player? It's better to establish a strategy." Although the market has soured on B2C plays, Proxis.com has already established a fast-growing B2B side to its business--selling to libraries, universities, and corporations--that generates 25 percent of all sales. And Staelens is well-prepared to answer a wary investor's concerns about the future of his business model with two pages of reasonable, point-by-point answers to the big question, "Will the B2C e-commerce model prove successful over the long term?" No hype, no spin. Just common-sense replies such as, "Not all B2C e-commerces are the same." I am rooting for this confident, sensible and smart CEO, his company, and the rest of the Belgian Net industry. "There's no reason we would spin off something if the market isn't going to appreciate the value of it," said Mel Karmazin during Viacom's Q2 earnings conference call. Right now, the market is indeed ugly for content issues: ScreamingMedia had a broken IPO yesterday, closing at $10.50 after offering shares at $12, while other content spin-offs such as NBCi have withered. But MTVi's problems may go beyond industry-wide investor coolness. Lately, the division has been a revolving door (its CTO was the latest to jump ship). With its IPO on ice and paltry stock-option packages rendered worthless, those turnover problems will likely increase. Register.com escalated its protests about Verio's direct-marketing campaign with a complaint filed against the company in NYC federal court. The dispute stems from Verio's use of register.com's whois database to contact recent domain-name registration customers and pitch Verio's Web-hosting services. Register.com's complaint charges Verio with misleading register.com customers into believing register.com and Verio are affiliated, and with violating the whois database's terms of use. (Use of information in the database for unauthorized commercial purposes is prohibited.) Register.com says its lawyers sent Verio a cease-and-desist letter in May, which halted the spam for a short time before Verio redoubled its efforts. For its part, Verio maintains that it has done no wrong. "The information as registered is public information," a spokeswoman told the Daily for an earlier article. "It's a standard marketing practice." The Internet Corporation for Assigned Names and Numbers (ICANN) rolled its call-for-proposals date for new top-level domain (TLD) registries back one month. Instead of releasing the application form at the start of the month, as originally scheduled, ICANN posted a detailed overview of the application process and the plan for implementing new gTLDs. The outline introduces two different types of TLDs: those managed by "sponsoring organizations" and those left unsponsored, over which ICANN will retain sole policy-making authority. The distinction seeks to delegate detailed management of niche TLDs--.union could be one example--to groups close to the TLDs' constituency, while leaving general TLDs (like .info) unfettered. ICANN also plans to allow both unrestricted TLDs that can be used by any interested party for any purpose (as .com, .net, and .org currently are) and restricted TLDs (such as .edu and .gov). In addition to a $50,000 application fee, ICANN will require detailed supporting documentation and technical specs. The organization hinted that it's unlikely to award multiple TLDs to any one group, referring applicants to its stated goal of pursuing a diversity of proposals and enhancing competition at the registry level. ICANN now plans to post the application form on Aug. 15, open the application period on Sept. 5, and close the period Oct. 2. Portions of the applications will be available to the public Oct. 5. ICANN hopes to complete negotiations and approve a handful of new registries by the end of 2000.
